General Terms and Conditions (GTC)
§ 1 Scope of Application
These Terms and Conditions (T&C) apply to all orders and services concluded via our website. Deviating terms and conditions of the customer shall not apply unless we have expressly agreed to their validity in writing.
§ 2 Contracting Party
The purchase contract is concluded with: ABATE STUDIOS.
§ 3 Conclusion of Contract
The presentation of products in the online shop does not constitute a legally binding offer but an invitation to place an order. By clicking the order button, the customer submits a binding order for the goods contained in the shopping cart. The confirmation of receipt of the order is sent together with the acceptance of the order immediately after submission by an automated email.
§ 4 Prices, Shipping Costs, Taxes, and Customs Duties
(1) The prices listed on the product pages include the statutory value-added tax (VAT) of the Federal Republic of Germany and other price components, unless otherwise stated.
(2) In addition to the stated prices, we charge shipping costs. These will be clearly communicated to the customer during the ordering process.
(3) Deliveries within the European Union (EU):
For deliveries to private customers within the EU, German VAT generally applies, provided that the seller does not exceed the EU-wide delivery threshold of €10,000 per year. If the seller exceeds this threshold, taxation will be based on the applicable VAT rate of the destination country (OSS procedure). In such cases, the customer will be informed accordingly.
(4) Deliveries to non-EU countries (e.g., USA, United Kingdom):
For deliveries to countries outside the EU, in particular the USA and the United Kingdom, German VAT will not be charged. The customer is solely responsible for the proper payment of all applicable customs duties, import taxes, and other charges of the respective destination country. These additional costs are not covered by ABATE STUDIOS. It is the responsibility of the customer to inform themselves about possible import duties prior to placing an order.
(5) For countries with specific customs and import regulations, we reserve the right to provide additional instructions or requirements by email after the order has been placed.
§ 5 Delivery
Delivery is available worldwide. Delivery times are indicated during the ordering process. Any deviations from the stated delivery times will be communicated on the respective product page or by email.
§ 6 Payment
Payment is made by credit card or other digital payment methods.
§ 7 Retention of Title
The goods remain our property until full payment has been received.
§ 8 Right of Withdrawal
Consumers have a statutory right of withdrawal of fourteen days. Details on the right of withdrawal can be found in our Withdrawal Policy.
§ 9 Warranty
Statutory warranty rights apply.
§ 10 Disclaimer for Natural Dyes
(1) Our products are hand-dyed using natural dyes. Due to the natural characteristics of these dyes, color variations between individual products may occur. Minor differences in shade, intensity, or pattern do not constitute defects but are inherent to hand-dyed natural products.
(2) We do not guarantee color consistency, color fastness, or permanent color stability. In particular, repeated washing or exposure to light and environmental factors may cause changes or fading in color. We accept no liability for such color changes.
(3) Any further liability related to coloration is excluded to the extent permitted by law.
